Call for trans men to invade public women’s bathrooms in Houston

houston hero transLEXIE CANNES STATE OF TRANS — Some people just don’t understand what they’ve voted for until it comes back to bite them in the face. If there’s ever a time for that to happen, it’s now in Houston, Texas.

Once upon a time the city fathers of Houston had the foresight to adopt a trans equality ordinance. One of the particular tenets was that trans people had the right to use the restroom of their expressed gender. But no longer.

As of November 3, 2015, for whatever reasons, voters in Houston choose to rid the city of its trans equality ordinance and roll the city back to the 20th century. It wasn’t even close — it passed by an almost 2 to 1 margin.

While the new law is clearly contrary to federal law — meaning it is likely to be overturned in federal court, but that’s down the road a bit — voters in Houston succumbed to fear mongering tactics.

I’d say the best way to fix this is to enlist the help of our trans brothers and launch a massive invasion of public female bathrooms in Houston with reporters in tow. Trans men now have a legal right to be in the ladies’ room. So, lets serve it up and let them have it.

    • As a transman I would e leery to doing this. You are trusting the powers that be in Texas to do the right thing here? While legally we can go in the women’s room, they couldn’t legally arrest us. But that won’t stop redneck cops to do so. They would wind up getting physical and shooting many trans people. I back our cause. But I have never been arrested or have a record of any kind. I don’t want this on my record forever. And I don’t trust cops to do the right thing. A better dig might be to reinvent the chastity belt and display it next to the women’s room. Just to make a statement.

      • Have you been to jail for justice? Get a backbone and stop leaving the fight for trans equality squarely on the shoulders of women.

        • Should he have to fight simply because he exists? He happens to be trans so now he is REQUIRED to take up the fight? I might say that’s OK if being trans was a choice and part of making that choice is you have to fight, but it’s not. So, just like I CHOSE to join the army potentially having to fight for and defend others who wouldn’t or couldn’t fight, I also accept the burden of fighting for this man’s rights.

But hey….I do respect your stance…..unfortunately I will not use a guys bathroom from threat of harm and fear harm for using the ladies….I dont get that luxury

      • The really stupid thing is people are so ignorant to what transgender look like. If the picture is suppose to be a male to female person I doubt they would have a full beard or be to the point where they would be using the ladies room. If this is suppose to represent a female to male person then that person could easily use a stall in the men’s room and no one would have any idea. The entire thing hinges on keeping the public ignorant to the facts of the process and making it a fear.

      • I absolutely know that such a move would get many trans people hurt or arrested… This is not a sane way to fight for trans rights. Sue the city county state and get the ACLU to be your lawyer, then ask for donations. Meanwhile, silly privileged white straight people stop telling anyone else how to live or how to fight for justice. that goes for those on both sides of this issue.

        • So, do you think MLK, Gandhi, Nelson Mandela, et al were not sane because they were not afraid to be arrested to stand up for human rights?

          And you don’t seem to know how lawsuits work either. You can’t overturn a law through a civil suit, you need to be a defendant (ie ARRESTED) in a criminal case to have standing to challenge and overturn laws.

          We shouldn’t look down on people who aren’t interested in civil disobedience, but we shouldn’t disparage the “sanity” of those who are willing either.

          But arrested, they won’t have a case, if they have not corrected their legal documents to reflect their true gender.

      • I understand and respect your point; I had the same thought. As someone else who’s never been arrested at a protest, I can’t be judgmental. Others, though, who now what they’re getting into, may be willing to face this — I hope they come out alright and get big settlements for any illegal police action they suffer,

        I must sadly note, however, that it’s still safer for you than it would be for trans women going into the men’s room for this protest; at least you’d mainly only have to worry about the police, more than the cis restroom users… 😦 (Which I assume is partly why this call is only for men.)

        • So, I totally get that this comment is about the call of transmen on the issue, but I would like to point out transwomen are doing it too. 🙂 when I first saw this issue popping up close to a year (or so) ago, this thing was being started (or so the article that I read gave this woman credit for) by a transwoman by the name of Brae Carnes. She wanted to make a point of how out of place she looks in the men’s facilities and urged other transfolks to join her in these bathroom selfies.

      I need to point out a couple things about this Houston issue. First, a new law was NOT created. It was just a repeal of HERO. I think it’s worth pointing out because if even trans-advocates are confused about this, can you imagine how justified a bible thumping bigot will feel confronting a trans-person in the restroom? Again, the repeal of HERO does NOT make it illegal to enter a women’s bathroom if you are born genetically male. Same thing for Transmen. They are not barred from men’s room.

      What it does roll back to is the 1972 law on the Houston books which states: ““It shall be unlawful for any person to knowingly and intentionally enter any public restroom designated for the exclusive use of the sex opposite to such person’s sex without the permission of the owner, tenant, manager, lessee or other person in charge of the premises, in a manner calculated to cause a disturbance.”
      Many advocates have argued that “disturbance” mean “intent to harm someone”, but it’s not that simple as you have seen. There are a lot of dumb people in Houston. Disturbance could mean different things to different people. Ironically, a bible thumper may get disturbed by the sight of a transgender woman in a women’s restroom. Then what? They would be making the disturbance, but the transgender woman would probably be arrested. Watch it happen.

      With regards to Michael Hughes’ picture and a call to “invade” men’s restrooms. I’ll let you decide. Who do you think the police are going to think went in the restroom with the intent to cause a disturbance? You guessed it!

      The law will not be on your side in this kind of protest but not for gender issues. It would be because they were intent on causing a disturbance.

      We need to think carefully before stepping in doo-doo. I’m sure there is a good way to protest, I am not sure this one would have the intended effect.

      • Thanks for your comments. I’ll let the masses decide on the matter, however, historically, rights (of any kind) didn’t come without bloodshed. Yes, there’s a risk of danger and everyone is willing to take a stand, but there are those that will.

        • I understand. If people are willing to risk jail time that’s great. They should just know what they will be arrested for. If an organized bunch of people are intent on causing a disturbance, that will be the offense. Not because they are genetic women in a men’s room. So, when they are arrested it will be untruthful to say “I was arrested because I was a woman in a men’s bathroom”. That’s not what they will be arrested for.

          • The point of doing this would be the strong public statement and media visual, NOT provoking any particular legal charges. I can imagine such an act of civil disobedience (or in this case, ironically, radical civil “obedience”) would bring all sorts of charges ranging from disturbing the peace, loitering, trespassing, etc. But right now trans women are being murdered and beaten for daring to leave the house. City after city is passing or considering passing laws that will basically criminalize the existence of trans people in public, particular trans women. The transgender community is incredibly small, numerically. We will never get results using the conventional channels. It takes showing people exactly what they are signing up for to get mainstream attention.

            I really hope some brave trans men step up and follow suit! I think it could be the one thing that would get through to the mainstream that they simply cannot pass laws to police the bodies and lives of others without dramatic, unintended consequences.

            My only criticism is that I wish this were a call to “OCCUPY” women’s restrooms. It would tie in to the larger civil rights resistance movements of the 21st century. It has a specific political meaning. “Invade” sounds like you are breaking and entering with the intent to do people harm. NOT a message it behooves us to send.

  3. Another thing that contributed heavily to the HERO ordinance losing was low voter turnout. Only 25% of eligible voters voted.

    • Agree, low voter turnout hurts us everywhere — we’ve nobody but ourselves to blame — there are more registered Democrats than Republicans.

      • And that’s likely to happen in the Presidential election of 2016 if voter turnout is low. People have died to secure our right to vote. Why anyone would sit on their fat ass instead of going out to vote — AND THEN BITCH WHEN THE STOOPIDS GET ELECTED — is behind me!

    • Tori, right on!! There is a discussion going on, over on my FB Wall, about how this could be organized and how it could be made effective and heck of a lot safer for a whole army of trans men to effect a protest by occupying women’s public restrooms in Houston (and elsewhere). A very brilliant friend of mine, Amanda, who happens to also be a beautiful trans woman, suggested a FLASH MOB. I said, yeah, let’s make it musical and REALLY catch them off guard, really disarm them. She replied, a moving target is harder to hit. 🙂 Not to make fun of a VERY serious situation. But we are both absolutely sober and serious about the idea. If that does not attention and keep the dialog going, I don’t know what will… getting video and putting it on youtube and vlogging the heck out of flash mob protests would keep things in the public eye in a way very few people could ignore.

  6. As someone living in Springfield, MO who repealed a similar ordinance back in April by using much of the same scare tactics, absolutely this. Stupid bathroom argument. I go to restrooms to use the facilities and nothing else.

  7. I am going to try to remain calm in light of this regressive piece of legislation. Do not the voters that okayed this law understand that now they’ve opened the door to more oppressive and regressive laws to be enacted? What is to keep laws prohibiting sales of certain foods on certain days, the wearing of different types of clothing (there could be a law that says everyone could now be required to wear cowboy boots and 10 gallon hats)? Or a law saying that Southern Baptist is now the state religion of Texas? Yes these are extreme examples of what could happen, but these examples could happen. That’s my point. ANY TIME there is a law that takes away the rights of a group of citizens, all the citizens can loose their rights, period.

    • Did I miss something? How do they plan to enforce this law without making everyone pull down their pants? Not to mention, post op m-f trans women are hard to tell. Just one more reason to have Texas removed from the union.

      • I don’t think it’s about enforcement, but rather harassment. Woman calls the cops on a trans woman who’s using the bathroom because they feel “threatened” or whatever.

        • Taking into consideration the absolute lunacy of this whole thing, don’t be surprised if any woman, cis OR trans, that doesn’t meet some fantastical criteria of perfect femininity falls prey to this. Maybe a stray hair or two on the chin? Happens in middle age; maybe you forgot to pluck that day. But hey, a REAL woman wouldn’t have hair on her chin, right? Okay, maybe I’m stretching the point, but I don’t think so, considering the fantasy of fear that’s gripped too many of the good people of Houston.

        • Those women have every right to contact the authorities if they feel threatened. Aren’t some transgender women attracted to women? Try to see it from their point of view. I like to think that I have an open mind when it comes to ‘taboo’ issues but a line has to be drawn somewhere.
          I’m going to be blunt-If you have a penis use the men’s bathroom and if you have a vagina use the women’s bathroom. Just my opinion.

          • Why would they feel threatened by transgender woman in the restroom who hasn’t done anything? I understand if people make you feel uncomfortable. I sure as heck do not like the chinese lady who picks her toes and smells them while sitting naked on the benches in the locker room. I try to be tolerant of everyone. And I am tolerant of people who don’t want to see transgender people in the restroom too. I would not feel too comfortable knowing I make you uncomfortable. Honestly, I would leave rather than cause a ruckus. That’s just me. Luckily I haven’t found anyone like that yet. Now that this is mainstream news I am sure that will change and people will feel more comfortable telling me I don’t belong. Thanks to the lies of the opposition. I just wish people would have some compassion. Where do you really expect us to go? My choices are to go into the mens room and get harrassed or go into the womens room and get yelled at. That’s why transgender people are so upset about the lack of tolerance about this. That and these lies that we are any more prone to commit a crime than anyone else in the world.

Agreeing with Avery’s earlier comment: With the repeal of HERO, TransGuys are “obligated” to use the Ladies rooms now, as their “right” to use the Men’s rooms without the risk of arrest was just taken away. And in reference to another comment about not wanting to be attacked or shot by the police, the suggestion to make an obvious point of doing what the voters were tricked into, would be with support and possibly press on hand.

  10. There are some misconceptions here that I think need to be corrected although I am totally ashamed of the action of Houston voters. First, the Houston Equal Rights Ordinance (HERO) was not just for trans people. It guaranteed anti-discrimination and access to equal rights based on 15 classes, including race, gender, military status, pregnancy, age, religion, etc. as well as sexual orientation and gender identity. HERO was originally passed by the City Council but was challenged in court and ultimately ordered by the Texas Supreme Court to be voted on by the general population of the city. That was the vote held on Tuesday and that vote removed HERO and it’s guarantee of equal rights for EVERYONE, not just trans folks. The voters did not pass a discriminatory law, just allowed such laws to possibly be enacted in the future. Second, there is currently NO state law in Texas concerning forced restroom usage by gender. Three such laws were introduced in the Texas Legislature in the past session but they all died. HERO would have prevented such laws in Houston. So, right now in Houston, things are back to where they were before HERO originally was passed by City Council. That means that although discriminatory laws (like bathroom gender restrictions) don’t exist, businesses CAN discriminate based on any criteria not protected by state or federal law. Like sexual orientation and gender identity.

      I understand Jami, and appreciate your accurate post. I think many trans people DO understand, and we simply resent being used in such a false and deceptive manner. Some of us have experienced discrimination within the LGBTQ community and for my part, I wonder at times if situations like this don’t adversely affect our standing within that community. No one likes to be seen as a liability and to be put into that situation by statements and actions not your own is quite frustrating, as I’m sure you can imagine.

    They talk about how the LGB won their status by being seen as Real People in Society. How many know a Trans Person.?? Think about what HELEN BOYD said:

    So WE need to get out there and be VISIBLE, so they [The Ignorant Society] start to see US as People also. It’s the Christian majority that needs to learn the Truth about us and not the Misinformation given out by the Clerics. This is shown when you take time to talk to regular people of what they know about US. Even many Trans, are not fully cognizant of how they got there.   15. Literally what is stopping any person from using a bathroom, they don’t check your ID when you walk through the door, or force you to show off your chest or lower half.. I use the men’s stalls and they still haven’t legalized it in Florida yet.. How do they expect this stupidity to go over well, as if they’re going to be able to look at someone, and tell?

    Trans men, we NEED you to do this. Now that HERO has been struck down, please be our heroes, and venture into the ladies room. While you’re in there, maybe remove your shirts and then brush your thick, curly tufts of chest hair. Maybe cast lurid, inappropriate stares for good measure. Maybe even lick your lips while casting these stares just to be over-the-top. But whatever you do, definitely make sure you have an eager female reporter (at least a reporter of sorts) in tow, both to immediately quell false accusations and as well to blow this story wide open.   19. Sure, ignore the transmen until you want to use them, how very transactivisit of you. I doubt trans men will do this as they were raised as women and know how to respect boundaries. Unlike the big mouths in the trans communities who want actual women to die for daring to speak out against you.

    • The point of “Give Houston What it Wants” is to show voters how horribly they were lied to in order to get enough votes to defeat the equal rights ordinance. So all of the NO votes were supposed to repeal the ordinance in order to ‘keep men out of the ladies restrooms’. I spent MANY MANY hours trying explain how repealing the ordinance would result in the getting exactly what they were saying they did NOT WANT. They repeatedly tuned me out and proclaimed “Born male, go to men’s room. Born female, go to ladies room”. So now that the got their way – let’s abide by that, as it is now the law, and give them what they wanted. TransGuys need to go to the ladies rooms, and TransWomen need to go to the men’s rooms, because with the ordinance now repealed, they’ve lost the protections from arrest it would have afforded them in their ‘preferred’ restroom befitting their new gender. So, we want to be there to help protect them from the surprised public, and tell that public “We told you so. You were lied to. Now what?”

You are not banned from going into the restroom of your gender identity as long as you do not intend to cause a disturbance. The term disturbance will become the next debatable word in the 1972 law. I can see how crazy church ladies get “disturbed” about just anything. Or maybe that trip to chipotle causes a disturbance. It’s a vague term, but it is not against the law to go to the bathroom. We just will have to bow to anyone who makes it out like we are causing a disturbance. We have no rights to be there. We can be tossed out by anyone who thinks we are disturbed.

  23. If you are a transgender woman suggesting a protest to “invade women’s spaces”, I would suggest getting more in touch with your feminine side. Women are vulnerable in the women’s room. If you are a woman, you know that. So why would you suggest doing this? It’s only going to backfire because it sounds like a plan a man would come up with. And you know that will be used as fuel to say we aren’t real and “see, they are all invaders and perpetrators”. There is a genuine need for women to feel safe. Have they misplaced their fear? Absolutely. Will this really change their minds that they were wrong? Absolutely not. They will twist it around to prove THEIR point. C’mon stop acting like a man. This won’t work. They need to see transgender people as normal, not invaders. This is a bad idea.

I live in Houston and if i see a man in the restroom I will do something about it….these trans women or shims can’t come in the ladies room or they would break the law. well guess what I’m looking to make a citizens arrest so come on in the bathroom with me, see what happens.

    • I don’t think Joanna knows what a TransMan is, and what the author is suggesting here is lost on her.

      Joanna, the voters have spoken, and they said they want people who were born male to go to men’s rooms, and born female – go to ladies rooms.

      THEREFORE: The suggestions is to not only follow their wishes, but do it publicly, in a group, to let people know that due to the lies they were fed, they pretty much got exactly what they did NOT want.

      YOU SEE: TransMen, such as Michael Hughes seen in photo above, were born female. So the voters WANT him to go the ladies rooms. He used to go to the men’s rooms, and HERO was supposed to help protect him from possibly getting arrested, even though there had been virtually problems with TransPersons already GOING to the restroom they preferred.

      NOW: We want to point out the absurdity of the HERO defeat, by actually having the TransGuys go where you people want them to: The LADIES Rooms – because they were born female.

    • How do you spot trans people, Joanna? Do you habitually demand to inspect the genitals of the person in the cubicle next to you? Do you check for GRS scars? How do you spot lesbians? Do you slip a sexuality survey under the door? What concern is it of yours what the orientation or genitalia of the person using the stalls has? You seem like a very sick individual.

  26. I will never accept transgenders, it’s a joke to me…I think it’s perverted and I will never think its ok. These men will never be actual women. It’s making a mockery out my gender. All transgender men do is rape the female body and appropriate it for themselves. Thats Selfish and sick.

    • Joanna, you are taking victims of nature, (not unlike people born as hermaphrodites, or someone with limbs missing, etc..), and making them into perpetrators. That’s despicable! So, according to your thinking, these variations in God’s creations should all be left as is? So the person born without legs should not obtain prosthetic legs to be able to walk? The person born with both physical sexes should not seek to change that situation – choosing the one that matches what they are internally? And given that last scenario, how do you not see that someone male on the inside can on rare occasion be born with female body (or vice versa)? You do know don’t you, that all fetus start out female, and along the way in the process, the correct chemical/hormonal changes happen based on DNA, but sometimes goes wrong? Just as many thousands of other things don’t go according to plan.

      • I’m not talking about hermaphodites I’m talking about men that say they were born in the wrong body. I wouldn’t be upset if a hermaphrodite they can’t help that they were born with both…you know exactly who I was talking about….i don’t agree with the “born in the wrong body” theory.

I’ll try one more time, but I REALLY don’t have time for this, especially since it has NOTHING TO DO WITH YOU !! I made the comparison to Hermaphrodite because they are born with an internal “Gender Identity” – with plumbing that doesn’t completely match. So it would follow that even on a less complicated level that a person can just as well be born with an Internal Gender Identity that doesn’t match the one kind of plumbing they ended up with because of some errant DNA. Why would you think this CANNOT happen while literally thousands of other kinds of errant DNA during development causing defects CAN HAPPEN. It’s odd that YOU seem to know that this one cannot be legit, but doctors around the world DO KNOW it happens, and developed procedures to help fix it, like they do all of the other ones. So, while I am not calling you any names, I do want to ASK YOU – if you are dense, or illiterate, or stubborn, or gullible, or just a sheep that believes what radical conservatives TELL YOU to believe….?

The general definition of male and female as determined by DNA is GLOBALLY used and agreed upon, which category all of us fit into is pretty straight forward and simple (let me know when THAT can be altered and we can talk about altering the general definition) This general definition does not in any way refer to the way you “FEEL” or “ACT” or “DRESS” or “LOVE” and its not supposed to……but you know what doesn’t refer to any of those either??? WHERE YOU GO TO THE BATHROOM
